The County Courts (Interest on Judgment Debts) (Amendment) Order 2019
The County Courts (Interest on Judgment Debts) (Amendment) Order 2019 was made on 24 April 2019 and shall come into force on 27 May 2019.
The 2019 Order amends the County Courts (Interest on Judgment Debts) Order 1991 to align with the provisions with rule 40.8 of the Civil Procedure Rules 1998 (CPR 40.8). CPR 40 enables the court to order interest on a judgment debt to run from a date different than when the judgment is given. The amendments will ensure that the County Court has more flexible powers and removes the detriment that a Claimant would only receive backdated interest for proceedings issued in the High Court.
The amendments to the County Court (Interest on Judgment Debts) Order 1991, will enable the court to backdate interest on a judgment debt to run from a date earlier than the date on which judgment is given or the amount of the judgment is determined.
