High Court success: Permission to appeal set aside and enforcement restored

September 22, 2025

Our client obtained judgment in the County Court for a significant sum following contested proceedings. The defendant subsequently secured permission to appeal to the High Court, together with a stay of enforcement. This development placed our client’s recovery of the judgment at risk and raised the prospect of further expense, delay, and unnecessary stress.

Although instructed only after the conclusion of the initial proceedings, we acted without delay to protect our client’s interests. Recognising the urgency, we prepared and advanced a comprehensive application to the High Court, presenting strong grounds to set aside permission to appeal and to lift the stay of enforcement. Our approach combined swift and decisive action with a thorough and professional presentation of the case, ensuring that our client’s position was robustly safeguarded.

The High Court granted our application in its entirety. Permission to appeal was set aside, the stay lifted, and our client was awarded their costs. By intervening quickly and effectively, we brought the matter to a close at an early stage, sparing our client the burden of defending an appeal, avoiding further costs and delay, and enabling immediate enforcement of the judgment. This successful outcome reflects our commitment to taking rapid, strategic action to secure the best possible results for our clients.
