The properties needed substantial alterations before they could be classified as residential properties, and as such could be mortgaged. The seller of the properties arranged for the solicitors, brokers, lender and builder for the buyers. The builder was incapable of undertaking the work, but the solicitor had failed to identify that the builder was required under the terms of the lending agreement despite that the builder was incapable of undertaking the work.
