Surveyors Negligence

When buying a commercial property, it is standard practice for the buyer to instruct a surveyor to assess the property’s state. This can give you a good standing point in property price negotiations, however when you are given incorrect information, poor advice or your surveyor does not act with a duty of care, the consequences can be devastating.Even if the buyer does not require a survey and instructs a professional surveyor, if a mortgage is funding the purchase, usually the mortgage lender will instruct a surveyor to conduct a survey of the property. Surveyors often play a very important part in any property valuation and the subsequent price paid for the property surveyed. The expertise and experience of the surveyor is usually central to the determination of property value and thus any mistakes made that would not reasonably have been made by another professional of the same qualification, that is any mistake in value of 10-15% above or below the correct value, that surveyor is classed as committing professional negligence.

In some circumstances, the negligent actions of a surveyor may result in a legal cause of action for negligence.  At Muldoon Britton, we are able to assist should you wish to bring a claim of professional negligence against a surveyor who has been negligent.  Similarly, if a professional negligence claim is brought against you as a surveyor but you feel that the claim is unjustified, Muldoon Britton can assess your case and honestly state whether the claim is valid, and whatever the circumstances represent you to resolve the matter as quickly as possible.
