Professional Negligence
Qualified professionals (such as accountants, financial advisers, solicitors, surveyors or estate agents) have a duty of care to clients, which commands them to act with reasonable skill and care when advising or providing services.
Where a professional does not act with reasonable skill and care, does not meet their professional obligations, or makes a mistake that a reasonably competent professional in the same circumstances would not have made, this may amount to professional negligence. Where this has resulted in financial losses, you may be entitled to compensation for professional negligence.
Professionals will usually have the benefit of professional indemnity insurance. Assuming that liability is established, you will be able to recover some or all of your losses and the majority of your legal costs of bringing the claim. In any event, we will provide you with clear advice about costs and the various ways of funding a professional negligence claim, as well as commercial advice at every step of the case.
Given that professional negligence claims are often not well received by prospective defendants, it is never advisable to take action yourself and you should always seek immediate legal advice from an experienced solicitor.
At Muldoon Britton, we appreciate that every case is different and therefore, take a personalised approach when exploring the merits or demerits of your individual case. In doing so, we make sure that we can support you in achieving the best possible outcome.
